How

How is the tenancy terminated?

Notice can be given verbally or in writing from the person or nearest relative giving notification to terminate a tenancy.

The Housing Department will need to receive confirmation that the tenant has been allocated residential care on permanent basis. Usually a letter from a member of the Social Services Department or from the Home itself will suffice. The tenancy cannot be terminated until this letter has been received.

Important information to include:

Name of tenant
Address of the property
Whether they have been allocated a permanent residential place.
Date of allocated place if applicable.

What happens next?

On receipt of notice you will be sent an acknowledgement letter within 14 days. Attached to this letter is a 'Termination Form', which must be completed and returned to the Housing Department before you terminate your tenancy.

Our requirements from you?

You must leave the property, the fixtures and any furnishings we have provided in good condition when you go. Do not leave any of your belongings behind - the Council will dispose of them and charge you for the cost of this.

You must pay for repair or replacement if damage to Council property has been caused deliberately or by your own neglect, including failure to report disrepair to the Council. You will not have to pay for normal wear and tear.

You are responsible for settling any outstanding charges in respect of your home including rent, council tax, gas, water and electricity. You should also ensure the supplies of electricity, gas and water are turned off and meters read as appropriate.

You must not leave anybody else living in your home when you move out. You cannot pass on your tenancy (called "assignment") to anyone else.

By arrangement with a Housing Services Officer..

The keys should be returned to these offices no later than 12 noon on Monday following the termination date. Failure to do so will result in an extra week's rent being charged.

YOUR RENT FOR THE PROPERTY MUST BE PAID UP TO THE TERMINATION DATE. HOWEVER, IF THE KEYS ARE NOT RECEIVED FROM YOU BY THIS DATE THEN RENT WILL CONTINUE TO BE CHARGED.

Q When will the tenancy terminate?

A Notification must be given to the Housing Department of the tenant's permanent residential placement. Once this has been received and the "Termination of Tenancy" form is completed it is then possible to hand the keys back to the Housing Department. The tenancy will terminate on the Sunday following receipt of the keys.

Q Do I have to clear the property of personal possessions?

A Yes. You can contact Refuse Special Collections on 01223 235468 who may be able to take certain items.

Q Can a relative take over the tenancy?

A No this is not possible, the property must be re-allocated following the Councils Lettings Policy and Procedures
