Leaseholders Responsibilities
Equity Share non-warden (ES) / Shared Ownership Leases / ES First time Buyers
Tenants responsibilities:
- To maintain the premises inside and out, landlord's fixtures and fittings and all tanks, cisterns, sanitary and water apparatus, pipes and cables in or exclusively serving the premises
- To decorate the premises inside and out
- To maintain the garden and fences
- Not to make external alterations and additions of any sort or any structural alterations and to make internal non-structural alterations only with the Council's written consent
- To permit the Council entry (upon written notice) to inspect the premises and the occupier must carry out any works notified by the landlord within three months. (If not the Council can do the works and recharge the occupier)
- To insure the premises
Landlords Responsibilities
- To maintain pipe conduits, drains and sewers under adjoining property, excluding those within or exclusively serving the demised premises
- To maintain any unadopted roads and paths
- To maintain communal parking areas and forecourts and paths
- To keep the common amenity areas neat and tidy
- Structural defects
The occupier is required to serve notice in writing of a structural defect as soon as it becomes apparent. They must permit the Council access for inspection and repairs and the Council must make good any damage caused in carrying out this work.
Equity Share - Wardened Scheme
- To repair, cleanse and keep in good and substantial repair and condition the interior of the premises and landlord's fixtures and fittings and all tanks, cisterns, sanitary and water apparatus, pipes and cables in or exclusively serving the premises
- To clean the windows
- To keep the garden tidy (where appropriate)
- To decorate internally
- Not to make external alterations and additions of any sort or any structural alterations and to make internal non-structural alterations only with the Council's written consent
- To permit the Council entry (upon written notice) to inspect the premises and the occupier must carry out any works notified by the landlord within three months. (If not the Council can do the works and recharge the occupier)
- To notify the Council of any repairs needed for which the Council is responsible.
Landlords Responsibilities
- To maintain the structure of the property and in particular roof foundations, external walls, external wood and woodwork, ironwork, load bearing walls, window frames (excluding internal surfaces), timbers (including joists and beams of floors and ceilings, chimney stacks and outside faces of external doors
- If the Council carries out any work to the load bearing walls or timbers it shall make good all damage to internal surfaces
- To maintain pipes, sewers, cables within the development, excluding those within and solely serving the premises
- To maintain the common parts (road, paths, forecourts, landscaped areas, common rooms etc)
- To maintain boundary walls and fences of the development
- To provide and maintain an alarm system
