Smoke free legislation

Cigarette butts on the floor

If you work or run a business - including driving taxis or delivery vehicles - new regulations that came into force on 1 July 2007 will affect you.

The Department of Health should have sent a smoke free information pack to all businesses registered with Companies House during April. The pack contains signs you need to display as well as details on how to comply with the law.

If your business is not registered with Companies House, or you have not received your pack, copies are available to order or download from www.smokefreeengland.co.uk/resources (This link will open in a new window). The packs are also available in other languages.

The new law

From 1 July the use of tobacco, (including anything containing tobacco), pipes, cigars and water pipes is prohibited, in enclosed or partially enclosed buildings and some vehicles. In other words it is an offence to smoke in an indoor enclosed workplace or public place. Smoking is still allowed outside. This means that virtually all enclosed public places and workplaces will be smoke free, including pubs, clubs, private membership clubs, cafés, restaurants, shopping centres, offices, and all public and work transport.

Vehicles

Licensed vehicles such as taxis and mini cabs must be smoke free at all times. Even if the vehicle is being used as a private car and the driver is off duty they cannot smoke in their vehicle. The legislation covers all company and work vehicles, like delivery vans and lorries, that are used by more than one person. Even if there is only one person in it, and more than one person sometimes uses the vehicle, it has to be smoke free at all times.
