Parish Council or member of the public

A section 106 agreement is usually completed between the land owner and District Council although in certain instances other signatories may include the County Council and even Parish Council. The purpose of the agreement is to:

  • Prescribe the nature of the development to achieve planning objectives (i.e. restricting the use of land)
  • Mitigating the impact of development (e.g. making provision for contributions towards local education facilities)
  • Compensating for loss or damage by a development (e.g. requirement to provide habitats for species affected as a result of development)

In accordance with national guidance local planning authorities (LPA's) need to demonstrate that the contributions they seek are in accordance with the tests as explained in the previous page. Planning policy documents are adopted as part of the local development framework and provide the evidence and justification for securing contributions.

Whilst the District Council has adopted these policies it should be highlighted that they are subject to viability and, especially with the current changing economic climate, it is recognised that some developments are simply unable to afford to comply with all policies and still proceed. The community infrastructure regulations 2010 is intended to bring a radical change in the way in which local infrastructure is achieved from new development. Planning agreements, as we know them will only be responsible for delivering onsite infrastructure such as affordable housing and open space. Contributions to fund the provision of wider infrastructure, schools, transport, highways, community facilities etc will be secured via a tariff applied to all new development over 100 square metres on a gross internal floor area basis. In the year 2010 South Cambridgeshire District Council received and passed to Parish Council's more than £250,000 in respect of public open space and community facility contributions. The District Council publishes information as to the agreements signed and monies received on a regular basis to create a transparent process and encourage Parish Council's to forward plan for the receipt of contributions.
