North West Cambridge Area Action Plan "Objection Sites" Consultation
The North West Cambridge Area Action Plan (jointly prepared by South Cambridgeshire District Council and Cambridge City Council) was submitted to the Secretary of State on 19 May 2008. During the six-week consultation that followed a number of representations were received proposing alternative sites for development, known as "Objection Sites". The Councils are seeking your views on these Objection Sites through a six-week period of public consultation from 8 September to 20 October 2008.

Government appointed Planning Inspectors will scrutinise the Area Action Plan at a Public Examination in Autumn 2008. A pre-hearings meeting conducted by the Inspectors took place on the 9 September 2008 at The Guildhall, Cambridge. The oral sessions of the Examination are expected to start on Tuesday 25 November 2008. Site Specific Policies DPD Examination
The Inspectors examining the Site Specific Policies DPD announced in March 2008 that they have found a shortfall in the dwelling capacity of land allocated in the various Development Plan Documents submitted in January 2006. The Inspectors propose to make up that shortfall by adding sites to the Site Specific Policies DPD and from the site allocated in the North West Cambridge Area Action Plan.
The Inspectors have asked the Council to carry out a comparative assessment of "Objection Sites" following the sequential approach set out in the Core Strategy DPD and submit a list of the Council's preferred sites for allocation.
A report on this issue was considered at the Planning and New Communities Joint Portfolio Holders' Meeting on 6 October 2008, which resolved to agree the report subject to call in (5 working days). The Council will hold a six-week period of public consultation to seek your views, which is anticipated to start in early November 2008. The Council will consider your responses and then recommend to the Inspectors the sites it considers should be allocated for additional housing development to make up the housing shortfall; this is anticipated to take place in February 2009. The Inspectors will consider the Council's proposals, the 'Objection Sites' and the results of the consultation, and have indicated they will hold additional hearings, before making a final decision on which sites will be allocated to meet the target. The Inspectors' decision will be included in their report which is binding on the Council.

Legal Challenge to the Core Strategy Development Plan Document (DPD)
The legal challenge by Countryside Properties Plc into the Core Strategy DPD will be heard at the High Court on Monday 27 and Tuesday 28 October 2008.
After the adoption of the Core Strategy, there followed a six-week period during which any person aggrieved by the document could make an application under Section 113 of the Planning and Compulsory Purchase Act 2004 to the High Court, on the grounds that the document is not within the appropriate powers and / or a procedural requirement has not been complied with.
On Thursday 8 March 2007, South Cambs received notification of such a legal challenge by Countryside Properties Plc. This challenge related only to paragraph 4.10 of the Core Strategy. Until such time as the High Court decides otherwise, the Core Strategy stands adopted in its entirety. If the challenge is successful, the decision would only remove the final paragraph of the plan.

Supplementary Planning Documents
The Council consulted on four draft SPDs in June/July 2008, these were: Developments Affecting Conservation Areas; Open Space in New Developments; Public Art; and Trees & Development Sites. The representations received will be taken into account in finalising the SPDs before their adoption in November 2008. It is anticipated that the Council will consult on a further three draft SPDs covering Biodiversity; Landscaping; and Listed Buildings in early 2009.
