Data Protection Act - Subject Access Request Procedure

How can I find out what personal data is being held about me or correct my personal data?

You can find out what information is held about you by sending us a Subject Access Request (SAR). All requests must be submitted using the form below, and include proof of identification. Once received, we will acknowledge your request, and send you a written response within 40 calendar days.

The response will include:

  • a description of the personal data
  • why the data is held
  • who else the data might have been given to
  • a copy of the data
  • an explanation of any technical terms or abbreviations
  • any information about the original source of the data

We can withhold some data if it refers to other people who have not consented to disclosure, if disclosure might cause serious harm to you or anyone else or might prejudice crime prevention or court proceedings. Even if we cannot provide you with copies of the data, we will confirm what type of data we hold and why we hold it.

How do I initiate a Subject Access Request?

A search fee of £10.00 is required for each separate request. The fee is not refundable even if the result of the search shows that there is no information to be supplied.

We will acknowledge receipt of your Subject Access Request (SAR) in writing and will send you a written response within 40 working days.

The full cost of any printing, photocopying and posting will be charged in accordance with the Council's standard charges.

How do I correct my personal data which is kept by the Council?

If we hold personal data about you, which is not correct, please email informationmanagement@scambs.gov.uk (This link will open in a new window)or telephone us on 03450 450 500. It would be helpful if you tell us the service for which we hold your personal data.

If you are unhappy with our response, you should contact the Office of the Information Commissioner. This is the organisation that ensures compliance with the Data Protection Act 1998. You can then ask the Commissioner to carry out an assessment to ensure that personal data is being processed in accordance with the Act.
